So I’m being sued…

I didn’t have the best of sleep again last night. It was my fault though; I should have put my cell phone in my office as I usually do before I sleep, instead of in the livingroom. I can’t hear it two rooms away, but I can hear it one, so it woke me up around 11 AM.

After finishing a bowl of not-so-tasty oatmeal and a glass of orange juice, I went to my computer to start checking my e-mails and sites as I usually do. My Hotmail account contained 10 spam messages, sigh. As I was about to mark them as spam I noticed that one of them may not have been spam after all. I deleted the other 9 and then opened the e-mail.

You can see why I had mistook it for spam the first time. The e-mail was sent to me from some lawyer’s office in Nevada, and then about 2 minutes after I was still shocked by the e-mail, I received another one, but from Flair Polos Inc. themselves, explaining they were going to arrange for their lawyers to contact me. It appears the lawyers from www.801injured.com/car-accidents/  were already on top of it…

They’re after my site PokerForums.org. They claim they own trademarks and can usurp the domain and site form me, since I’ve been “profiting from them”. Ugh.. can I really lose PokerForums.org? It’s just a domain and is very generic… are they going after PokerForums.net and PokerForums.com as well? It is advisable to talk to G&S DUI Attorneys at Law. Maybe this was just a scare tactic or something, but then I remembered something which scared me even more: the phone call that woke me. I went to grab my cell phone from the livingroom and sure enough there was a voice mail left for me. Wanting to get it over with ASAP, I dailed into my voice mail and sure enough it was them. At least the guy who phoned me sounded very nice and was very polite in his message. Checking if there are no contest pleas while being sued is crucial.

But two e-mails and a phone call to Sweet Lawyers brings you world-class car accident attorneys. I guess I have to go find the best retaliation lawyers ASAP and see what my options are. I can’t just give the site up.. it’s my main source of revenue and uh.. I don’t know what I’d do without it. It’s Saturday right now too.. I wasn’t aware lawyers worked on Saturdays.. why would they send this to me on the weekend and not on Monday? Same with the phone call.. isn’t that kind of strange?

Lawyers here work Monday-Friday, 9-5 usually, so I’m gonna have to wait a couple days until Monday before I can respond anyhow. Go to the page to fina an attorney to help you with legal matters.

Which leaves me wondering if they’ll try to take away all the money I made from the site too.. I don’t think so though.. they seem to be mainly after the domain, but are trying to take the website too. I doubt they’ll get the website.. because that makes no sense.. why would they get that? I also did a Google search for “Flair Polos Inc.” but couldn’t find anything, but the e-mails and phone call sure sound legit…

Ugh………. wish me luck guys, it feels like I’ve been punched in the stomach…

    Relax… C&Ds are a common scare tactic. They are pretty much worthless. They can’t take your site. I’d also bet they’d have a hell of a time trying to get such generic domain. Plus you are in Canada. Yeah, get a lawyer to advise you. I’d let them suck wind. They can’t do shit about shit. They are just trying to bully you.

    Yeah, that letter doesn’t sound very lawyer-like… “failure to comply with this law” …. and the previous sentence has words bolded and enlarged… most lawyer’s offices probably use straight text, one font size. And, “cease and desist all attempts to collect the above debt”… It doesn’t fit. Obvious April fools joke. Font sizes are all varied.

    Also, lawyers are prone to using more latin based english words. I doubt if they often have their secretaries write in 1st person.

    And, you copied and pasted the bottom part wrong. I can see an extremely light blue border about 1 pixel wide on the left side. Heck, even the font size of the blurred text blocks are smaller.

    Good one though.

  5. Either Tyler is playing an April fools joke. Or he has having one played on him. Based on the inspecific-ness, I’d say its Tyler playing it.

    Heh yep id bet an April Fools prank. I have received a threat of being sued once in the past via email. For one thing, you are not allowed to disclose anything in the email and second, like Ulchie said, it isnt proper-sounding.

    Good one tho, one of a few I have already seen. Today will be very interesting 🙂

    I read it today, so not much shocked. Sometimes reading the news late is good for health 🙂
